Terms and Conditions

The use of this website, operated and maintained by Patchings Art Centre (referred to as "we", "us" and "our"), is subject to the following terms and conditions. Any purchase or transaction made over this website is also made, subject to the terms and conditions below.

We reserve the right to change or amend the conditions outlined below. Any changes made will come into effect from the point at which they are available on the website. A change in the terms and conditions will not affect transactions made previous to the amendment, only transactions which take place after it has been made available.

1. Payment. We must receive full payment for the goods and any additional charges before we can accept and dispatch your order. Payment can only be made from a debit card or credit card registered with a UK bank account. Confirmation of the acceptance of your order will be sent to the email address that you have provided. We reserve the right to cancel or decline any order for any reason. In accepting your order, we bring into existence a legally binding contract between us. All prices shown on the website are non-negotiable.

1.2 Where you are not a consumer, but acting on behalf of a business, you accept and confirm that you have the right and authority to enter the business you are acting for into the legal binding with us.

1.3 VAT. VAT (Value Added Tax) is included in all prices that are laid out in the website, wherever it is payable. VAT is charged at 17.5%.

1.4 Currency. All prices and charges included in the website are given in UK Pounds Sterling (GPB).

1.5 Delivery Charges. Extra costs will be incurred to cover delivery charges. These charges are non-negotiable. The amount charged for delivery is dependent on the weight of your order. The delivery charge will be viewable in the "shopping cart", and will increase as the weight of your order increases.

1.6 Total. The total charge that you will pay is the cost of the order, the delivery charge, and any other charges that you have incurred.

1.7 All items and prices displayed on the website are subject to availability and may change without reason. Changes made to items or prices will not affect orders accepted before these changes are made, only orders which are subsequent to these changes.

1.8 In the event that we have listed or displayed an item incorrectly, we will amend it as soon as possible. If there is an error in an item which you have ordered, then we will notify you of this as soon as possible, and you will be given the option of accepting these changes, or cancelling your order.

2. Delivery guarantee. We will deliver the items in your order as soon as possible after the order has been accepted. Please ensure that all documentation, including receipts sent with the item, is retained. We will post the items via Royal Mail, or where this is not possible, using Fastway Couriers. Items may require a signature on delivery.

2.1 In the event that parts of an order will need to be sent as separate consignments, we will notify you of this.

2.2 Upon the acceptance of your order, we will try to dispatch your order within five working days and at most 30 working days, provided that all items in your order are in stock at that time. Upon dispatch, you will be notified, and given an estimated delivery date.

2.3 If goods in your order cannot be delivered to you within 30 days, for any reason, we will cancel that part of your order, and refund you the cost. We are not in any way liable to you if we are unable to send part of your order due to reasons beyond our control.

2.4 We cannot be held liable for goods which are lost, damaged, stolen, or misused once they have been delivered.

2.5 In the case of the goods received being incorrect, damaged or defective, or the incorrect quantity has been sent, you must email, or write to the address provided. You must report the problem within 24hrs of receipt of the item, in order to allow us to deal with the problem with the least delay.

3. Cancelling the contract. You can at any point cancel your contract (and order) at any time within seven working days of the receipt of your order. Your reason for cancelling the contract is not required, although it may be helpful.

3.1 You cannot cancel your contract if for any reason:

3.1.1 The warranty has been void on the item(s) within the order (where applicable)

3.1.2 Consumables (including but not limited to paints, paper, and pencils) have been used, or are not present in their original quantities/volumes.

3.1.3 Proof of purchase is not present

3.1.4 Items have been personalised to you in some manner

3.1.5 Items have been marked, damaged, or are no longer in "as new", resaleable condition

3.1.6 Items are incomplete, and/or no longer contain all of their original parts or accessories

3.2 To cancel the contract, you must notify us, via:

3.2.2 Posting written notification to: Sales, Patchings Art Centre, Oxton Road, Calverton, Notts, England, NG14 6NU

3.3 If you wish to cancel the order after it has been received, then clauses 3.1 to 3.1.6 must be satisfied. To do this, you must - at your own risk - send the items back to us, via a reputable postal service. We cannot be held responsible for items lost, damaged, or stolen during this process.

3.4 When we have received returned goods, you will be credited with the original cost, minus any postage and packaging costs.

4. We are not liable, and will not be liable under our contract with you for any consequential loss suffered as a result, direct or indirect, of your usage of this service. We will not be liable for any consequential loss suffered as a result of breaking any of our obligations.

4.1 When using this website, or making any orders from it, you must ensure that you comply with all regulations and legislation, especially with regard to the necessary customs and import permits and requirements. Some of the goods available on this site may not be permissible for export to certain countries where they are prohibited by certain national laws. We accept no liability with respect to the export or import of good purchased over our site.

4.2 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any statuary rights, or other rights you may have under English law, that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury caused by our negligence.

4.3 We cannot be held responsible for any losses you suffer as a result of your information being used by a third party, unless we are negligent. We will take reasonable precautions to ensure that your order and payment details are kept secure.

5. We, or our licensors, own the copyright, trademarks and all other intellectual property rights in all material and content of this website. Any reproduction of this material, except for personal use, is strictly prohibited.

6. The availability of this website is in no way guaranteed, and it is in no way implied that this website will remain here for your use. We are not liable for any bugs, viruses, errors or malicious software which you contract through this website. We are not liable for any loss of information as a result of it passing to, from, or through this website.

7. The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have exclusive jurisdiction (except where we deliver to Scotland, in which case the Scottish courts may also have jurisdiction) to resolve any disputes between us. English is the language offered for the conclusion of the contract between you and us.

9. You agree to be bound by the terms of our privacy policy.

Privacy Policy

Privacy Policy Patchings Art Centre does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies. Data collected by this site is used to:
